- 服務條款的確認及接受
- 本DiFluid Café APP（以下稱「本應用程式」）各項電子服務的所有權和運作權均屬於深圳市流數科技有限公司（以下稱「流數科技」）所有，本應用程式提供的服務將完全按照公布的服務條款及操作規則嚴格執行。您確認所有服務條款並完成註冊程序時，本協議即在您與本應用程式之間成立並發生法律效力，同時您成為本應用程式的正式使用者。
- 根據國家法律法規變化及本應用程式營運需要，流數科技有權不時修改本協議條款及相關規則；修改後的內容一旦以任何形式公布於本應用程式上即生效，並取代此前相關內容。您應不時關注本應用程式公告、提示資訊、協議、規則等相關內容的變動。您知悉並確認，如您不同意更新後的內容，應立即停止使用本應用程式；如您繼續使用本應用程式，即視為您知悉變動內容並同意接受。
- 流數科技保留隨時修改或中斷本應用程式服務而無須通知您的權利，並無須承擔因此對您或第三方造成的任何後果。
- 本協議內容中以粗體方式顯著標示的條款，請您特別閱讀。您點選「同意」按鈕，即視為您完全接受本協議；在點選之前，請您再次確認已知悉並完全理解本協議的全部內容。
- 服務須知
- 基於本應用程式提供的網路服務，您確認並同意：
（1）提供的註冊資料真實、準確、完整、合法有效；註冊資料如有變動，應及時更新；
（2）如果您提供的註冊資料不合法、不真實、不準確、不完整，您需承擔因此引起的相應責任及後果，且流數科技保留終止您使用本應用程式各項服務的權利。
2、關於您在本應用程式上的帳號、密碼和安全，您確認已知悉：
（1）您一旦在本應用程式上註冊成功，便成為本應用程式的正式使用者，將獲得一個使用者帳號；該帳號可使用您設定的密碼登入流數科技的所有網頁及本應用程式；
（2）您應當採取合理措施維護您的帳號和密碼安全；
（3）您應當對使用您的帳號和密碼登入本應用程式或流數科技其他網頁所進行的一切活動承擔全部責任；
（4）若您發現您的帳號和密碼遭受未經您合法授權的使用，或發生其他任何安全問題，您可以立即通知流數科技；
（5）因網路技術原因以及為了更好地保障您的帳號和密碼安全，請您在每次連線結束後及時停止使用您的帳號；若您未及時停止使用帳號，流數科技無法保障您的帳號和密碼安全；
（6）若您超過5年未使用您的帳號，流數科技有權關閉您的帳號並刪除該帳號內的內容。
三、使用者個人資訊保護及授權
1、您知悉並同意，為方便您使用本應用程式相關服務，本應用程式將儲存您使用時的必要資訊，包括但不限於您的暱稱、頭像、聯絡方式（包括行動電話號碼、電子郵件等）、相簿、行事曆、定位資訊等。除法律法規規定的情形外，未經您的許可，流數科技不會向第三方公開或透露您的個人資訊。流數科技會對相關資訊採取專業的加密儲存與傳輸方式，並利用合理措施保障使用者個人資訊的安全。
2、您使用本應用程式某項特定服務時，該服務可能另有單獨協議、相關業務規則等（以下統稱為「單獨協議」）。您在使用該項服務前，請閱讀並同意相關單獨協議；您使用前述特定服務，即視為您已閱讀並同意接受相關單獨協議。
3、您充分理解並同意：
（1）為配合行政監管機關、司法機關執行工作，在法律規定範圍內，流數科技有權向上述行政、司法機關提供您使用本應用程式時儲存的相關資訊，包括但不限於您的註冊資訊等，或使用相關資訊進行證據保全，包括但不限於公證、見證等；
（2）流數科技依法保障您在安裝或使用過程中的知情權和選擇權。在您使用本應用程式服務的過程中，涉及您裝置內建功能的服務會事先徵得您的同意；您一經確認，流數科技有權啟用包括但不限於收集地理位置、讀取通訊錄、使用相機、啟用錄音等提供服務所必要的輔助功能。
（3）流數科技有權根據實際情況，在法律規定範圍內自行決定單一使用者在本應用程式及服務中資料的最長儲存期限，並在伺服器上為其分配最大資料儲存空間等。
四、使用者行為規範
1、您同意在註冊帳號時遵守以下命名規則：
（1）請勿以黨和國家領導人或其他社會名人的真實姓名、藝名、筆名註冊；
（2）請勿冒充任何人或機構，不得使用容易令人誤認為與任何人或機構存在關聯的名稱註冊；
（3）請勿使用與其他使用者名稱相近、相似的名稱註冊；
（4）請勿以不文明、不健康的名稱註冊，註冊名稱中不得包含歧視、侮辱、猥褻類詞語；
（5）請勿使用容易產生歧義、引起他人誤解的名稱註冊。
2、您同意嚴格遵守法律法規及規章規定，依法遵守以下義務：
（1）不得製作、傳輸或發表以下違法資訊資料：反對憲法所確定的基本原則，煽動抗拒、破壞憲法和法律法規實施的；危害國家安全，洩露國家秘密，顛覆國家政權，破壞國家統一，煽動推翻社會主義制度的；損害國家榮譽和利益的；歪曲、醜化、褻瀆、否定英雄烈士事蹟和精神，侵害英雄烈士姓名、肖像、名譽、榮譽的；宣揚或煽動實施恐怖主義、極端主義及其活動的；煽動民族仇恨、民族歧視、破壞民族團結的言論；煽動非法集會、結社、遊行、示威、聚眾擾亂社會秩序；破壞國家宗教政策，宣揚邪教和封建迷信的；散布謠言，擾亂經濟秩序和社會秩序的；散布淫穢、色情、暴力或者教唆犯罪的；侮辱或者誹謗他人，侵害他人名譽、隱私和其他合法權益的；法律、行政法規禁止的其他內容。
（2）防範和抵制製作、複製、發布含有下列內容的不良資訊資料：標題嚴重誇張、發表內容與標題嚴重不符的；不當評論自然災害、重大事故等災難的；煽動人群歧視、地域歧視等的；宣揚低俗、庸俗、媚俗內容的；違反社會公德行為的；侵犯未成年人合法權益的；其他對網路生態造成不良影響的內容。
3、本協議依據國家相關法律法規及規章制定，您亦同意嚴格遵守以下義務：
（1）從中國大陸向境外傳輸資料資訊時，必須符合中國相關法規；
（2）不得利用本應用程式從事洗錢、竊取商業秘密、竊取個人資訊等違法犯罪活動；
（3）不得干擾本應用程式的正常運作，不得侵入本應用程式及國家電腦資訊系統；
（4）不得傳輸或發表任何違法犯罪、騷擾、中傷他人、辱罵、恐嚇、傷害、庸俗、不文明等資訊資料；
（5）不得教唆他人从事违法违规或本協議、平台規則所禁止的行為；
(6) Do not use an account registered on this Application to conduct profit-making business activities, including but not limited to uploading advertisements, banners, or logos.
(7) Do not publish any content that infringes another person's personal information, copyright, trademark rights, or other intellectual property or lawful rights.
4. You shall bear legal responsibility for your statements and conduct on this Application. If you disseminate or spread reactionary, pornographic, or other information violating national laws on this Application, system records of this Application may be used as evidence of your violation of the law.
V. Rules for Use of This Application
1. Obtaining and Updating This Application:
(1) You may obtain this Application directly from the App Store or Google Play, or from a third party authorized by 流数科技. If you obtain the software from a third party not authorized by 流数科技, 流数科技 cannot guarantee that the software will function properly and shall not be responsible for any losses thereby caused to you.
(2) To improve the user experience and enhance service content, 流数科技 will continue developing new services and provide you with software updates from time to time. After a new version is released, the old version may no longer be usable. 流数科技 does not guarantee the continued availability of old software versions or the corresponding customer service. Please check for and download the latest version at any time.
2. Unless permitted by law or authorized in writing by 流数科技, you may not engage in the following activities while using this Application:
(1) Delete copyright information from this Application or its copies.
(2) Reverse engineer, reverse assemble, reverse compile, or otherwise attempt to discover the source code of this Application.
(3) Use, rent, lend, reproduce, modify, link to, republish, compile, publish, issue, or establish mirror sites for content in which 流数科技 owns intellectual property rights.
(4) Reproduce, modify, add to, delete, attach to, or run any data released into the memory of any terminal during the operation of this Application, any interaction data between the client and server during the operation of the Application, or system data necessary for the operation of the Application, or create any derivative works based on such data, including but not limited to accessing this Application and related systems through plug-ins, cheats, or third-party tools or services not authorized by 流数科技.
(5) Modify or forge instructions or data during the operation of the Application to add, delete, or alter its functions or operating effects, or operate or publicly disseminate software or methods intended for the foregoing purposes, regardless of whether such conduct is for commercial purposes.
(6) Log in to or use this Application or its services through third-party software, plug-ins, cheats, or systems not developed or authorized by 流数科技, or create, publish, or disseminate such tools.
(7) Interfere with this Application or its components, modules, or data, either independently or by authorizing others or third-party software to do so.
VILiability for Breach of Contract
1. If 流数科技 discovers or receives reports or complaints from others that you have violated this Agreement or engaged in any malicious conduct, 流数科技 shall have the right, without notice, to delete or block the relevant content at any time and, depending on the circumstances, impose penalties on the offending account, including but not limited to warnings, restrictions on or prohibitions against using some or all functions, account suspension, and account cancellation, and announce the results of such action.
2. 流数科技 shall have the right, based on reasonable judgment, to take appropriate legal action against conduct that violates applicable laws, regulations, or this Agreement, and to preserve relevant information and report it to the relevant authorities in accordance with law. You shall solely bear all legal liability arising therefrom.
3. You understand and agree that you shall independently bear responsibility for any claims, demands, or losses asserted by third parties as a result of or arising from your violation of this Agreement or the relevant terms of service. If 流数科技 suffers losses as a result, you shall also compensate 流数科技 accordingly.
4. Unless expressly stated otherwise in writing, 流数科技 makes no representations or warranties of any kind, express or implied, regarding the operation of this Application or the information, content, materials, products, or services contained in or provided through this Application, except as otherwise provided by the laws of the People's Republic of China.
VII. Ownership and Intellectual Property Rights
1. Upon accepting this Agreement, you grant 流数科技 and its affiliates, free of charge and until the end of the term of protection, an irrevocable, worldwide, exclusive license to use the copyright in and all related lawful rights and interests concerning any information content in any form that you provide, upload, create, or publish on this Application, including but not limited to text, comments, images, photographs, videos, and audio (including reviews by other users and articles on various topics). The copyright license includes, without limitation, the rights of reproduction, distribution, rental, exhibition, performance, screening, broadcasting, dissemination via information networks, cinematography, adaptation, translation, compilation, and all other licensable rights that should be enjoyed by a copyright owner, as well as portrait rights and user ID names. With respect to rights and interests for which 流数科技 has standing to sue, 流数科技 shall have the right to collect evidence of and bring legal actions against third-party infringements in its own name. You agree that 流数科技 and its affiliates shall have the right to store, use, reproduce, revise, edit, publish, display, translate, distribute, promote, issue, and disseminate via information networks the foregoing information content; create derivative works based on it; and incorporate the foregoing information into other works in known or subsequently developed forms, media, or technologies.
2. 流数科技 shall have the right to sublicense all rights under Paragraph 1 of Article VII to other third parties.
3. You shall ensure that none of the various types of information and content published on this Application under Paragraph 1 of Article VII infringes any third party's portrait rights, privacy, intellectual property rights, or other lawful rights and interests. Otherwise, 流数科技 shall have the right to take measures at any time, including but not limited to deleting content and disabling links.
4. This Agreement constitutes a written agreement granting a license to use copyright property rights and other rights under Article 26 of the Copyright Law of the People's Republic of China (the article numbering is based on the 2020 revised version of the Copyright Law) and relevant laws and regulations. Its effect extends to any work content protected by copyright law that you publish on this Application, regardless of whether such content was created before or after the formation of this Agreement.
5. You agree that you fully understand the terms of this Agreement and undertake not to publish, or authorize any other entity to use in any manner, the information published in this Application in any form, including but not limited to use on various websites and media.
6. Except where mandatory provisions of law provide otherwise, without the express special written consent of 流数科技, no entity or individual may illegally reproduce, republish, quote, link to, scrape, or otherwise use all or any part of the information and content of this Application in any manner. Otherwise, 流数科技 shall have the right to pursue legal liability.
7. The materials and information published in this Application, such as text, charts, logos, button icons, images, sound file clips, digital downloads, data compilations, and software, are the property of 流数科技 or its content providers and are protected by Chinese and international copyright laws. The compilation of all content on this Application is the exclusive property of 流数科技 and is protected by Chinese and international copyright laws.
VIII. Applicable Law, Jurisdiction, and Miscellaneous
1. The formation, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of China. If any dispute arises between the parties concerning the content or performance of this Agreement, the parties shall first attempt to resolve it through friendly consultation. If consultation fails, an action shall be brought before the competent people's court at the place where this Agreement was signed. The place where this Agreement was signed is Longhua District, Shenzhen, Guangdong Province, People's Republic of China.
2. If any provision of this Agreement is deemed void, invalid, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity or enforceability of any remaining provisions.
3. Any other rights not expressly granted under this Agreement remain reserved by 流数科技. You must obtain separate written permission from 流数科技 when exercising these rights. If 流数科技 fails to exercise any of the foregoing rights, this does not constitute a waiver of such rights.
